{"id":6863,"date":"2016-09-20T11:47:54","date_gmt":"2016-09-20T09:47:54","guid":{"rendered":"https:\/\/openasia.org\/en\/?p=6863"},"modified":"2016-09-20T11:47:54","modified_gmt":"2016-09-20T09:47:54","slug":"four-months-left-to-close-guantanamo","status":"publish","type":"post","link":"https:\/\/openasia.org\/en\/2016\/09\/four-months-left-to-close-guantanamo\/","title":{"rendered":"Four months left to close Guant\u00e1namo"},"content":{"rendered":"<p><a href=\"https:\/\/openasia.org\/en\/wp-content\/uploads\/2016\/09\/Guantanamo.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-6864\" src=\"https:\/\/openasia.org\/en\/wp-content\/uploads\/2016\/09\/Guantanamo-300x68.jpg\" alt=\"guantanamo\" width=\"300\" height=\"68\" srcset=\"https:\/\/openasia.org\/en\/wp-content\/uploads\/2016\/09\/Guantanamo-300x68.jpg 300w, https:\/\/openasia.org\/en\/wp-content\/uploads\/2016\/09\/Guantanamo.jpg 667w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p>Dear friends and supporters,<\/p>\n<p>With just <a href=\"http:\/\/closeguantanamo.us4.list-manage.com\/track\/click?u=c0748d3f311618789d2b32209&amp;id=888b9a0e6d&amp;e=309e724c7a\" target=\"_blank\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=http:\/\/closeguantanamo.us4.list-manage.com\/track\/click?u%3Dc0748d3f311618789d2b32209%26id%3D888b9a0e6d%26e%3D309e724c7a&amp;source=gmail&amp;ust=1474444304681000&amp;usg=AFQjCNG6qZ8L3jhc2lE3lXoUaPRFZuItuQ\">four months left<\/a> for President Obama to close the prison at Guant\u00e1namo Bay, as he promised when he first took office in January 2009, we confess that we do not share the optimism of those we know who think the president will finally fulfill his long-unfulfilled promise, as Congress is still almost fanatically opposed to his plans, and it will be difficult to close the prison and move the men to another facility or facilities on the mainland without lawmakers&#8217; support.<\/p>\n<p>However, we were delighted to hear recently that Camp 5, a 100-cell block of solid-walled, isolated cells, which opened in 2004 and was modeled on a maximum-security prison in Bunker Hill, Indiana, <a href=\"http:\/\/closeguantanamo.us4.list-manage2.com\/track\/click?u=c0748d3f311618789d2b32209&amp;id=790cdce0ef&amp;e=309e724c7a\" target=\"_blank\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=http:\/\/closeguantanamo.us4.list-manage2.com\/track\/click?u%3Dc0748d3f311618789d2b32209%26id%3D790cdce0ef%26e%3D309e724c7a&amp;source=gmail&amp;ust=1474444304681000&amp;usg=AFQjCNHhKOMhjKFPdFNp4DrOkKn5VUa6Ew\">has been closed down<\/a>, and its remaining prisoners moved to Camp 6, where prisoners live communally. Camp 5 will be converted into a clinic and psychiatric ward, and its closure as a prison will cut the military personnel working at\u00a0Guant\u00e1namo by around a fifth \u2014\u00a0from 1,950 to 1,550 \u2014\u00a0helping to wind down operations.<\/p>\n<p>Camp 5 is also where two men died, in 2007 and 2012, and last week Kevin Gosztola of <a href=\"http:\/\/closeguantanamo.us4.list-manage.com\/track\/click?u=c0748d3f311618789d2b32209&amp;id=37e7f8ebdf&amp;e=309e724c7a\" target=\"_blank\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=http:\/\/closeguantanamo.us4.list-manage.com\/track\/click?u%3Dc0748d3f311618789d2b32209%26id%3D37e7f8ebdf%26e%3D309e724c7a&amp;source=gmail&amp;ust=1474444304681000&amp;usg=AFQjCNG9qD7pq94UBNmSOPsLxAbFezgPXQ\">Shadowproof<\/a> spoke to two attorneys at the New York-based Center for Constitutional Rights, who explained how horrible Camp 5 was. Shayana Kadidal called it \u201cthe original large-scale solitary confinement facility at Guant\u00e1namo,\u201d describing it as \u201cone of the most inhumane places to hold men\u201d at Guant\u00e1namo, which \u201cwon\u2019t be missed,\u201d and Wells Dixon said, \u201cGood riddance to a place that caused so much pain and misery for our clients for so many years.\u201d<\/p>\n<p><strong>The failure to close Guant\u00e1namo<\/strong><\/p>\n<p>The failure to close Guant\u00e1namo is not through indifference on President Obama\u2019s part \u2014 at least, not lately. Confronted for most of his presidency by cynical Republican obstruction, he spent years failing to fight back, even though <a href=\"http:\/\/closeguantanamo.us4.list-manage.com\/track\/click?u=c0748d3f311618789d2b32209&amp;id=6c2bc3b8b6&amp;e=309e724c7a\" target=\"_blank\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=http:\/\/closeguantanamo.us4.list-manage.com\/track\/click?u%3Dc0748d3f311618789d2b32209%26id%3D6c2bc3b8b6%26e%3D309e724c7a&amp;source=gmail&amp;ust=1474444304681000&amp;usg=AFQjCNGKeEVUK9DscdljlPjdCBiGN3uvlw\">the means to do so were at his disposal<\/a>, and it is only in the last three years that he has made up for lost time, <a href=\"http:\/\/closeguantanamo.us4.list-manage1.com\/track\/click?u=c0748d3f311618789d2b32209&amp;id=3d89f2f7ae&amp;e=309e724c7a\" target=\"_blank\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=http:\/\/closeguantanamo.us4.list-manage1.com\/track\/click?u%3Dc0748d3f311618789d2b32209%26id%3D3d89f2f7ae%26e%3D309e724c7a&amp;source=gmail&amp;ust=1474444304681000&amp;usg=AFQjCNEWKxoiPk_p8fNVTYDYB9bhY0chKw\">releasing over a hundred men<\/a> and bringing the prison\u2019s population down to <a href=\"http:\/\/closeguantanamo.us4.list-manage1.com\/track\/click?u=c0748d3f311618789d2b32209&amp;id=9ad8405816&amp;e=309e724c7a\" target=\"_blank\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=http:\/\/closeguantanamo.us4.list-manage1.com\/track\/click?u%3Dc0748d3f311618789d2b32209%26id%3D9ad8405816%26e%3D309e724c7a&amp;source=gmail&amp;ust=1474444304681000&amp;usg=AFQjCNEgndDWAnaHLe0RIM49ziXGtmRskg\">just 61 men<\/a>\u00a0\u2014 the 46 now in Camp 6, and 15 &#8220;high-value detainees&#8221; in Camp 7.<\/p>\n<p>Furthermore, 20 of those men have been approved for release, 13 by the Periodic Review Boards that have also been reviewing prisoners\u2019 cases over the last three years \u2014 those not facing trials (just ten men) and not already approved for release by an earlier review process. 20 of the men approved for release by PRBs have already been freed, making up nearly a fifth of those freed in the last three years.<\/p>\n<p>64 men in total have had their cases reviewed by the Periodic Review Boards, which are made up of representatives of representatives of the Departments of State, Defense, Justice and Homeland Security, as well as the office of the Director of National Intelligence and the Office of the Joint Chiefs of Staff, and the last of the first round of reviews took place just two weeks ago. <a href=\"http:\/\/closeguantanamo.us4.list-manage.com\/track\/click?u=c0748d3f311618789d2b32209&amp;id=d3fd5a92f8&amp;e=309e724c7a\" target=\"_blank\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=http:\/\/closeguantanamo.us4.list-manage.com\/track\/click?u%3Dc0748d3f311618789d2b32209%26id%3Dd3fd5a92f8%26e%3D309e724c7a&amp;source=gmail&amp;ust=1474444304681000&amp;usg=AFQjCNFYBjZgysCgOVnUtrAaEVugN9KUUQ\">Please check out our definitive Periodic Review Board list for further details<\/a>.<\/p>\n<p>To date, 19 men have had their ongoing imprisonment approved by the PRBs \u2014 and 12 decisions have yet to be taken. Here at \u201cClose Guant\u00e1namo\u201d we are aware that, although the PRBs have done a good job, however belatedly, in reducing the population of Guant\u00e1namo, no one should complacent about thinking that those approved for ongoing imprisonment are being held in an entirely lawful manner.<\/p>\n<p>Although the U.S. has the right to hold people under the laws of war, the men at Guant\u00e1namo are still not held according to the Geneva Conventions, if they are regarded a soldiers, and, if they are alleged to have been involved in terrorism \u2014\u00a0as is the case with some of those whose ongoing imprisonment has been approved by PRBs \u2014\u00a0then they should put on trial and not held indefinitely without charge or trial.<\/p>\n<p><strong>The military commissions: not fit for purpose<\/strong><\/p>\n<p>We are also concerned about the inadequacy of the trial system \u2014 the military commissions \u2014 for the men facing trials, and in recent weeks Andy has been addressing these problems, firstly in his article, <a href=\"http:\/\/closeguantanamo.us4.list-manage.com\/track\/click?u=c0748d3f311618789d2b32209&amp;id=51737944a3&amp;e=309e724c7a\" target=\"_blank\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=http:\/\/closeguantanamo.us4.list-manage.com\/track\/click?u%3Dc0748d3f311618789d2b32209%26id%3D51737944a3%26e%3D309e724c7a&amp;source=gmail&amp;ust=1474444304681000&amp;usg=AFQjCNGzLiTespiEWGL4pSKy77h8TcnUrQ\">Tortured &#8220;High-Value Detainees&#8221; Arrived at Guant\u00e1namo Exactly Ten Years Ago, But Still There Is No Justice<\/a>, in which he looked at the cases of the 14 \u201chigh-value detainees,\u201d some of whom are facing PRBs, and some of whom are facing trials that are not fit for purpose, as they are permanently stuck in pre-trial hearings, while the government tries desperately to continue to hide evidence of their torture.<\/p>\n<p>We also recommend our latest article,\u00a0<a href=\"http:\/\/closeguantanamo.us4.list-manage.com\/track\/click?u=c0748d3f311618789d2b32209&amp;id=558184520a&amp;e=309e724c7a\" target=\"_blank\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=http:\/\/closeguantanamo.us4.list-manage.com\/track\/click?u%3Dc0748d3f311618789d2b32209%26id%3D558184520a%26e%3D309e724c7a&amp;source=gmail&amp;ust=1474444304681000&amp;usg=AFQjCNGMjR9xiyqUU_5Jz2cFxwFHSBZUMw\">Lawyer for Torture Victim and Guant\u00e1namo Prisoner Abu Zubaydah Writes Powerful Op-Ed for TIME<\/a>, in which we cross-post, with Andy\u2019s introduction, a recent op-ed by Joseph Margulies, who is one of the lawyers for Abu Zubaydah, for whom the brutal and counter-productive post-9\/11 torture program was conceived.
